The federal trademark registration process is what I like to refer to as “deceptively simple.” It appears to be an online form you just fill out, but it is so much more than that, my friend.
Submitting a federal trademark application begins a federal legal proceeding that can last anywhere from 8 months to 2 years. After filing your application, you are assigned to a USPTO (U.S. Patent & Trademark Office) Trademark Examining Attorney. This Examining Attorney’s job is to assess your trademark application & determine whether there are any issues within your application, if your trademark should be granted or rejected, & if there are any currently registered or pending applications on records that conflict with yours.
As with any other legal proceeding, it is in your best interest to hire an attorney to represent you & your interests in order to ensure that all of the i’s as dotted & the t’s crossed.
You may have heard from about sister’s cousin’s best friend that filed her application on her own & secured registration, however, this happens rarely. Hundreds of thousands of applications are submitted each year to the USPTO. A large percentage of those applications are rejected based on incorrect filings & mistakes made by non-lawyers. Should your application be rejected, you may find yourself 1) losing out on the initial $200+ filing fee you submitted when you filed it yourself; 2) Losing your filing priority date because you have to file a secondary application at a later date; and/or 3) Losing rights to your trademark because somebody else filed an application for your same trademark but they did it correctly (probably because they hired a professional).
The federal trademark registration process is a deceptively simple one. They say only a fool represents himself in court. We say only a fool represents his business himself before the USPTO.
